CCWCD Committee
February 5, 2019

The meeting of the CCWCD Committee of the Central Colorado Water Conservancy District was called to order at 11:07 A.M. on Tuesday, February 5, 2019 by Don Rosenbrock at Central’s office at 3209 West 28th Street in Greeley. Committee members present were Don Rosenbrock, Everett Kissler, Ralph Anders, Doug Dill and Jim Reasoner (via Skype).  Staff present were William Mihelich and Ruthanne Schaffer.  Guest present was Steve Smith from Applegate Group.

Steve Smith spoke with the Committee regarding the Ogilvy and Bijou Bypass agreements with C.E.R. that were previously approved in November 2018 and January 2019.  C.E.R. has offered to prepay all fees but according to what the Board approved in November 2018.  C.E.R is asking the Board to reconsider the November 2018 approval.

RECOMMEND TO THE BOARD TO MAINTAIN THE SAME TERMS AND CONDITIONS FOR THE CER BYPASS AGREEMENTS FOR THE OGILVY AND BIJOU BYPASS AS APPROVED IN THE JANUARY 2019 BOARD MEETING ($15,000 BUY IN FEE PER STRUCTURE PLUS $25/ACRE FOOT RUNNING FEE ON 300 ACRE FOOT PER STRUCTURE).

The Committee reviewed a chart staff is working on showing each structure, capacity, available space, and suggested fees to be charged.

William gave updates to the Committee on the Walker Recharge Project and the timeline.  The SOQ are due today.  Staff met with members of OWW regarding a possible Co-Op between the two entities.  Staff is discussing with Weldon Valley Ditch to move their diversion structure to a higher elevation to protect the ditch in times of flood and Central would get a 50cfs capacity structure to run water to the Walker Recharge Project.

Central received the final Rinn Valley storage and Rural share water decree.

The 2015 Chatfield refill right is almost settled, only Centennial and CWCB are still in the case.

William reviewed a memo he prepared regarding the Fullmer Class D Contract and a draft Class D contract that was prepared by legal counsel.

RECOMMEND TO THE BOARD TO APPROVE THE FULLMER CONTRACT WITH A ONE TIME CAPITAL ASSESSMENT FEE OF $17,200 PER ACRE FOOT, PAYMENT TO CCWCD MONTHLY FOR A TERM NOT TO EXCEED 12 MONTHS, FOR A MAXIMUM OF 6.5 ACRE FEET AND ANNUAL ASSESSMENT FEE FOR THE FIRST YEAR OF $3,000.

There was a meeting about the 1940s Agreement a couple weeks ago and negotiations with the parties involved were discussed.

Staff has been approached to purchase two lots of senior ditch shares.  White Sands is evaluating the shares.

Chairman Don Rosenbrock adjourned the meeting at 12:50 P.M.
